Successful Enforcement of Patent Prosecuted by FKM

ADASA Inc. obtained a unanimous jury verdict against Avery Dennison Corp. for patent infringement of U.S. Patent No. 9,798,967 (‘967 patent) relating to RFID transponders, in which the jury found that Avery Dennison infringed the ‘967 patent and awarded $26,641,876.75 in damages for past infringement. The court subsequently escalated Avery Dennison’s liabilities to ADASA Inc. to include award of attorneys’ fees and sanctions totaling to over $62 million and ongoing royalties.

Fay Kaplun & Marcin LLP prosecuted the patent application that issued as the ‘967 patent, and also successfully obtained a Reexamination Certificate on behalf of ADASA Inc., in an Ex Parte Reexamination proceeding before the USPTO requested by Avery Dennison Corp. challenging the validity of the ‘967 patent. ADASA Inc. was represented by Friedman, Suder & Cooke of Fort Worth, Texas in the litigation.
